Yes. HousingAnywhere is a Dutch company and conforms to Dutch law. Companies that aren't an intermediate between tenant and landlord and thus facilitate peer-to-peer communication can charge a fee for their services.

The Tenant Protection fee is a one-time fee. It's only charged when you confirm a booking.
